Rulemaking on
2019 Building Energy Efficiency Standards

The start of the formal rulemaking proceeding is January 19, 2018. The Notice of Proposed Action for the 2019 updates to the California Energy Code (Title 24, Part 6; Building Energy Efficiency Standards) and associated updates to the Administrative Code (Title 24, Part 1) and CalGREEN (Title 24, Part 11) was published on January 19, 2018. This begins the formal rulemaking process and the 45-day public comment period on the Draft Express Terms. These documents, as well as the Initial Statement of Reasons describing each proposed change and the Documents Relied Upon in determining appropriate amendments, are available by following the "Workshops, Notices, and Documents" link in the right hand column

A public hearing on the proposed changes is scheduled for February 5 and 6, 2018. The goal of this hearing is to receive oral comments from stakeholders that have reviewed the Draft Express Terms and would like to speak directly to Energy Commission management and staff. The hearing is open to the public, and can be attended remotely via either telephone or internet. More information, including agendas for each day.

The deadline for public comments on the Draft Express Terms is March 5, 2018 by 5:00 PM. Public comments can be submitted electronically to our e-filing system:

An adoption hearing for the updated 2019 Energy Code is scheduled for March 21, 2018. If no further changes to the Draft Express Terms are required, then the Energy Commission may consider adoption of the proposed changes at its March Business Meeting. Alternatively, if changes to the Draft Express Terms are made as a result of received public comments, then a Revised Express Terms will be published for public review and the adoption hearing rescheduled to a later Business Meeting.

About the Rulemaking

The California Energy Commission follows a public process and rulemaking proceeding to adopt changes to the Energy Code (also called the Building Energy Efficiency Standards) contained in the California Code of Regulations (CCR), Title 24, Part 6, and associated administrative regulations in Part 1 (collectively referred to here as the Standards). The updated standards will be proposed for adoption in 2018 with an anticipated publication date of January 1, 2019 and effective date of January 1, 2020. Previously open Docket 2016-BSTD-06 for the 2019 Time Dependent Valuation (TDV) of Energy, and Docket 2017-BSTD-01 for pre-rulemaking comments on proposed 2019 Standards measures, are closed.

Prior to the formal rulemaking proceeding California Energy Commission staff conducted workshops to present potential revisions to the Standards and obtain public suggestions and comment. After adoption of the 2019 Energy Code, the Energy Commission will resume working with stakeholders on development of formal code change proposals that can be considered in the next (2022) triennial update cycle of the California Building Standards Code.
