On August 26, 2005, the California Energy Commission received a petition from Otay Mesa Generating Company, LLC requesting approval to transfer the ownership of the Otay Mesa Generating Project from Otay Mesa Generating Company, LLC to Otay Mesa Energy Center, LLC. In addition, the name of the project will be changed to the Otay Mesa Energy Center.

The Otay Mesa Generating Project is a nominal 590 MW, natural gas-fired combined-cycle facility located in the City of San Diego in San Diego County. The Energy Commission certified the project in April 2001, and approved the sale of the project from PG&E Generating to the current owner in October 2004. Due to financing issues, construction of the project stopped in the spring of 2005 after approximately six percent of the project had been completed.


A statement describing the change in ownership, signed under penalty of perjury by a representative of the proposed new owner of the project, was submitted to the Energy Commission staff for review and approval as required by Title 20, California Code of Regulations, section 1769(b). The statement affirms that the new owner agrees to be bound by the requirements of the Energy Commission's Decision for the Project and understands the obligations imposed by the Conditions of Certification. Based on the information provided, staff intends to recommend the proposed change be approved by the Energy Commission at the September 21, 2005 business meeting.

The petition to change ownership is available on the Energy Commission's website at www.energy.ca.gov/sitingcases/otaymesa/compliance . The order (if approved) will also be posted on the website.
